This platform (the "Service") is owned and operated by Developer Shuaib, a sole proprietorship registered in Pakistan (NTN 4510493450805), operating under the website developershuaib.tech. By creating an account or using the Service, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service.

1. Description of Service

Developer Shuaib provides a multi-tenant software platform that lets businesses connect their own WhatsApp, Instagram and Messenger accounts and configure AI-powered automations — including chatbots, appointment booking, knowledge-base/RAG agents, comment handling, broadcast campaigns, and lead capture.

2. Account Registration

You must provide accurate business information when creating an account and keep your login credentials confidential. You are responsible for all activity that occurs under your account. You must be legally authorized to act on behalf of the business you register.

3. Connecting Your Own Meta (WhatsApp/Instagram/Messenger) Account

You connect your own WhatsApp Business number and/or Meta Business Portfolio to the Service via Meta's official Embedded Signup flow. Developer Shuaib never sees or stores your Facebook/Meta password.

Messaging costs are billed to you directly by Meta, according to Meta's own WhatsApp Business Platform pricing. Developer Shuaib does not charge for, mark up, or profit from Meta's messaging fees — the Service only charges its own platform subscription fee (see Section 4).

You are responsible for complying with Meta's own Platform Terms, WhatsApp Business Messaging Policy, and Commerce Policy. Developer Shuaib may suspend a connected account if Meta suspends or restricts it for policy violations outside our control.

4. Subscription, Billing & Payment

Access to the Service requires an active subscription (Growth, Pro, or Scale tier, or any successor plan published on our pricing page), billed monthly in advance in Pakistani Rupees (PKR) unless otherwise agreed in writing. Message-volume quotas and features vary by tier as described on the pricing page at the time of purchase.

Fees are non-refundable except where required by law. We may change subscription pricing with at least 30 days' notice before it applies to your next billing cycle.

5. AI Providers & Bring Your Own Key (BYOK)

You may either (a) supply your own API key for OpenAI, Anthropic, or Google Gemini — in which case that provider bills you directly at their own rates and Developer Shuaib does not mark up that usage — or (b) use AI capacity provided by Developer Shuaib's own platform key, billed to you as a per-message markup disclosed at the time you choose that option.

If you supply your own key, you are responsible for that key's validity, quota, and compliance with your chosen provider's own terms of service. Developer Shuaib stores BYOK keys encrypted at rest and uses them solely to generate replies on your behalf.

6. Acceptable Use

You agree not to use the Service to:

• Send unsolicited bulk messages (spam) or violate Meta's messaging policies;
• Transmit unlawful, defamatory, fraudulent, or harassing content;
• Attempt to reverse-engineer, resell, or white-label the Service without written permission;
• Upload knowledge-base content you do not have the rights to use; or
• Interfere with the security or normal operation of the Service.

7. Data & Privacy

Business data, conversation content, and knowledge-base documents you upload are stored to operate the Service on your behalf and are not sold to third parties. Data is stored using Supabase (PostgreSQL) infrastructure with tenant-level access controls. Full details will be published in a separate Privacy Policy; until then, this section governs data handling for the Service.

8. Intellectual Property

Developer Shuaib retains all rights to the Service's software, design, and branding. You retain all rights to your own business content (knowledge-base documents, system prompts, contact data) uploaded to the Service.

9. Service Availability & Disclaimer

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. Developer Shuaib does not guarantee uninterrupted or error-free operation, and is not responsible for outages caused by third-party providers (Meta, Supabase, OpenAI, Anthropic, Google, or similar).

10. Limitation of Liability

To the maximum extent permitted by law, Developer Shuaib's total liability arising from your use of the Service is limited to the amount you paid in subscription fees in the three (3) months preceding the claim. Developer Shuaib is not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities.

11. Termination

You may cancel your subscription at any time from your account settings. Developer Shuaib may suspend or terminate your account for violation of these Terms, non-payment, or misuse of connected third-party platforms.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email or an in-app notice at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Pakistan.
